What is the P1 Visa?
The P1 Visa is a visa for athletes and entertainers to enter the USA to participate in a competition or an entertainment performance. There are two kinds of P1 Visas, the P1A and the P1B. The P1A Visa is for individual athletes who are internationally recognized for high athletic achievement. This visa is also for team athletes where the team has been internationally recognized in the sport. The P1B Visa is for members of an entertainment group which has achieved international recognition as an outstanding entertainment group. 1. Live in the USA with P1 Visa
The applicant and immediate family will be able to legally live in the USA. Immediate family includes spouse and unmarried children under the age of 21. The athlete or entertainer is issued a visa called the P1 Visa, meanwhile immediate family (dependents) are issued a visa called the P4 Visa.
2. Work in the USA Visa P1
The P1 applicant will be authorized to legally work in the USA, this includes making promotional appearances.
3. Public Education with P4 Visa
The children will have access to public schools in the USA from Pre-K to university, without the need for a student visa.
4. Social Security Number & Driver’s License
The P1 Visa allows you to get a US Social Security Number and a driver’s license.
1. You must be an internationally recognized athlete or entertainment artist;
2. You must be invited to participate in a competition or a specific entertainment function in the United States; and
3. If you are an athlete, the event in which you will participate must be at an internationally recognized level of performance. If you are an entertainer, it is required that you be a member of an entertainment group, which is foreign based, and which has received international recognition. The international recognition needs to have been sustained for a substantial period. Also, entertainers must have been part of the entertainment group for at least 1 year.
1. Document Checklist for P1 Visa
Once you start the application process, the first thing our immigration attorney will do is provide you with a very detailed checklist of the documents needed to prepare your P1 Visa application. This checklist is custom made to your specific circumstances and therefore very important because it spells out exactly what will be needed from you to complete the application.
2. Application #1 filed with USCIS
Once you provide us with the requested documents, we will prepare Application #1 for the P1. This application is submitted to USCIS. On the average, the review process can take anywhere from 2 weeks with Premium Processing to 4 months without Premium Processing. Once USCIS approves Application #1, we then move on to Application #2.
3. Application #2 filed with US Consulate
The immigration attorney will prepare Application #2 which will be presented at a US Consulate in your home country. This step includes an interview by a US Consular Officer. Upon being approved, the P1 Visa is stamped onto the applicant’s passport. shortly after the interview.
4. P1 Visa Interview Preparation
Prior to the applicant’s L1A interview at the US Consulate (Application #2), you will have an interview preparation session with one of our immigration attorneys to help guide you. During this session, you will learn about the questions you are most likely to get during the P1 interview. The preparation will make you feel a lot more comfortable during your interview.
If you are an individual athlete, with the P1 Visa you can stay in the US for the period of time necessary to complete your event, competition or activity, without exceeding a total of 5 years. In this case, the P1 Visa can be renewed once for a total of 10 years.
If you are applying with an athletic team, then the visa is issued for the period of time needed to complete the competition, but for a maximum of 1 year. In this case, the P1 Visa may be renewed in increments of up to 1 year to continue to compete.
If you are applying as a part of an entertainment group, then the visa is issued for the period needed to complete the competition, event or performance, but for a maximum of 1 year. In this case, the P1 Visa may be renewed in increments of up to 1 year to continue to complete or perform.
1. Can I apply for a P1 visa extension?
Yes, you may apply to extend your P1 Visa or just your P1 status. The P1 extension of status applications are filed by mail with USCIS. Extensions of the P1 visa require that you first apply for an extension with USCIS and then apply for a new visa with a US Consulate outside of the USA.
2. How long do P1 visa extensions last?
Individual athletes may extend for another 5 years, team athletes may extend in 1-year increments, and members of an entertainment group may extend in 1-year increments.
3. Can I go from P1 Visa to Green Card?
Yes, you may apply for a Green Card via the adjustment of status process. Also, the P1 visa is a dual intent visa (except for support personnel). P1 Visa holders may apply for a Green Card via a family member or via their abilities. Those with extraordinary abilities may self-petition via the EB1 category. Those with exceptional abilities may apply for a Green Card via a US employer using the EB2 category.
4. Can I change employers while on the P1 Visa?
Yes, so long as the new employer files a new P1 application on your behalf.
5. With the P1 Visa, can I work for more than one employer in the US?
Yes, but each employer will need to file a P1 application on your behalf.
6. What is the P2 Visa?
The P2 Visa is a work visa for artists or entertainer participating in a reciprocal exchange program between an organization outside of the USA and an organization in the USA. The exchange program must be recognized by the US Government.
7. What is the P4 Visa?
The P4 visa is issued to dependents of P1, P2 and P3 visa holders. Dependents include spouse and unmarried children under the age of 21.
